THIS IS AN EXAMPLE OF HOW THE ANTI-ASSOCATION LAWS COULD BE ABUSED BY THE POLICE AND POLITICANS

 

Legal Comment By Wayne Baffsky Barrister  to UMCNSW

 

S.A. Opposition MP, Stephen Wade has called for the use of that state's anti-association laws to be used against a religious group, which is claimed to be a doomsday cult. As foreshadowed by the UMC (NSW) one of the dangers of these laws is that they could be used against any group of people. Not just a criminal organisation as defined in the various, similar state laws. And not just against 'bikies' as the state governments have been pointing out all around Australia.

 

Another foreshadowed danger was that these Acts target the innocent as well as the guilty. Here a member of parliament has called for the entire group to be punished, presumably, because only a few have, allegedly, committed a criminal act, not all of them. This is a real danger; if you can't prove the group has done anything wrong, you can punish them all anyhow.

 

We are watching the start of the most undemocratic piece of legislation in Australia, however, the real question is; where will it finish?
