High Court ruling on bikies to be revealed

A HIGH Court decision that will determine SA's new planned anti-bikie laws will be revealed this week.

The decision involves a Sydney-based Hells Angels member who has challenged the validity of the NSW government's Crimes (Criminal Organisations Control) Act 2009 in the High Court.

The State Government has been awaiting the NSW decision to see if it will impact on planned changes to its Serious and Organised Crime (Control) Act, which have been on the drawing board for more than six months.

The changes followed a High Court ruling last November against the SA government that effectively ruled a section of the SOCCA unconstitutional because it breached principles of judicial independence.

The government had appealed to the High Court following a Supreme Court decision in favour of two Finks members who had been subject to orders under Section 14(1) of the SOCCA.

The High Court's 6-1 majority decision dismissed the Government's appeal, ruling that section of the legislation was unlawful.
