Fugitive jailed
16 November 2006
A former Outcasts gang member who evaded police for months by holing up
in rural Waikato properties with firearms has been sent to prison for
eight years.
Name suppression was lifted today on Kim Bruce Smith, 42, when he was
sentenced in the High Court at Hamilton.
Smith faced charges of attempting and conspiring to defeat the course of
justice, multiple charges of unlawfully possessing firearms, ammunition
and explosives, and drug possession charges.
He pleaded guilty to the charges at an earlier court appearance.
Smith went into hiding at the end of 2004 after failing to appear in
court on unrelated charges.
He eluded police until August 2005, living in properties at Waingaro,
Port Waikato and Patumahoe, where he was eventually captured by police.
Police believed Smith was at a Waingaro in June 2005 when Andre Wilson
died from a gunshot wound to the chest. They stepped up the search for
him after the shooting and launched a major manhunt in north Waikato
bush.

While in the bush Smith was armed with weapons including rifles, a
shotgun and a pistol, and police say he was delivered drugs and food.
Justice Lang said Smith's sentencing needed to send a message.
"People who decide to deliberately avoid facing up to court proceedings,
and those who assist them need to know that if they are arrested...they
are likely to face severe sentences," he said.
Crown prosecutor Louella Dunn did not seek a minimum non-parole period
for Smith.
