Johnny Montani, 41, of Morley, faced trial in the West Australian Supreme Court for the wilful murder of former bikie gang member Kevin “Mick” Woodhouse, 36, on May 12, 2004.
Prosecutors alleged Montani, wearing dark clothing and a motorcycle helmet, shot Mr Woodhouse four times while the victim was sitting on a bench waiting for the Bayswater Waves Aquatic Centre to open.
But Montani maintained he had nothing to do with the shooting, telling the court he had loved Mr Woodhouse like a “brother”.
After sitting through three weeks of evidence and deliberating for two days, the jury was today discharged by Justice Narelle Johnson after it indicated it was not able to reach a unanimous verdict.
Montani was remanded in custody pending a retrial.
The matter will be before the courts again on November 8 for a status conference.
