THE national boss of the Comanchero bikie gang has beat police charges against him after a magistrate found he was unlawfully arrested.
Daux Hohepa Ngakuru
was the passenger in a Silver Subaru traveling at
over 200km per hour along Southern Cross Drive
during the early hours of the morning on July 26
last year.
When the vehicle was pulled over by police he was
hand cuffed, searched and locked up over night after
police found two valium tablets on him.
However Magistrate Robert Williams dismissed a
possession of prescription drugs charge against the
31-year-old today because the police officer
breached law enforcement powers by failing to tell
the bikie why he was being searched and arrested.
"It would appear from the evidence that has been
given by the officer no information was provided by
him to the defendant,'' Mr Williams told Waverley
Local Court.

Police Prosecutor Mark Drury told the court the
officer recognised Ngakuru from photos and knew he
was "high up in a motorcycle gang."
He said the officer also "didn't know if there were
firearms in the car."
Mr William dismissed the charges against Mr Ngakuru
and ordered the prosecution pay his $3000 legal
fees.
