NZ bikie fails Aussie character test

December 18, 2004

A NEW Zealand bikie associate who failed an immigration character test will not be able to return to Australia, where he lived for two decades, after his visa application was rejected.

Stephen Edward Hicks had been living in Australia for almost 20 years with his wife and family when a string of convictions for offences including assault, disorderly conduct and possessing weapons and drugs caught up with him.

Federal Court judge Robert Nicholson rejected Hicks's application for a special Australian visa, saying the Immigration Department had the power to refuse entry to people it thought were associated with crime.

Hicks, a self-confessed associate of notorious West Australian bikie club the Rebels, had his visa cancelled in November 2002 because of "a substantial criminal record" that meant he did not pass the Australian character test.

Hicks, who lived in Kambalda in the West Australian goldfields with his wife and siblings since 1986, was fined for the majority of his offences but given a suspended jail term of up to 10 months in February 2000 for assaulting two police officers.

At the time, the sentencing magistrate warned he would face jail if he reoffended.
