Rebel's death leads to fine for teen driver
26.02.2005
A FATAL accident involving a member of the Rebels Motorcycle Club led to a
teenager being fined in the Magistrate’s Court yesterday.
Jacob Alexander Martin, now 18, pleaded guilty to driving without due care and
attention on Marian-Hampden Road on November 6.
He did a slow U-turn as Rebels member Kerry Smith, 45, was riding his motorcycle
along the road within the 100kmh speed limit.
Mr Smith was unable to swerve to miss the vehicle and was killed. He was
subsequently given a biker’s funeral through the City Heart of Mackay.
Martin had not been driving dangerously but had failed to see the motorcycle
coming, the court heard.
Several Rebels were in court to hear Martin get fined $750 and be disqualified
from driving for six months.
Outside court, Martin’s mother, Robyn, said: ‘‘We wish to thank the Rebels and
the victim’s family for their tolerance and understanding.
‘‘It’s a terrible start to life for my son. And the end of a life for the
victim.
