The threat was revealed today in Southport Magistrates Court, where Bandidos bikie Peter Mauric is standing trial charged with rioting over the September 2013 brawl.
The defence has summonsed Mr Stewart and more than 80 officers who attended the infamous brawl to produce notebooks.
Lawyers for the Police Commissioner have argued the demand to produce about 600 notebooks is “oppressive” and “simply a fishing expedition”.
Defence barrister Geoff Foster said the summonses had been met with “deafening silence” by Commissioner Stewart and accused him of seeking to delay or refuse acceptance of the court orders.
Barrister Craig Capper, for Mr Stewart, said the defence had sent Mr Stewart an email last week threatening to seek a warrant for his arrest unless the notebooks were produced.
Magistrate Michael Quinn ordered that the summonses be set aside, ruling that they were “oppressive” and “an abuse of process”.
However, he directed Mr Stewart to provide any notes from officers relevant to the bikie brawl.
