Airport bikie brawl victim looked 'tiny': witness

A "tiny" Anthony Zervas lay motionless on the floor with blood running from his nose and mouth after a brawl at Sydney Airport, a court has been told.

The 29-year-old died on March 22, 2009, after a clash between rival bikie gangs in the domestic airport's terminal three, ending near a Qantas check-in area.

A witness, whose identity has been suppressed, was today giving evidence at the West Trial Court at Parramatta during the committal hearing of 10 men charged with murdering Mr Zervas and three others charged with riot and affray.

 

She told the hearing of how she rushed to Mr Zervas's aid once the fight had finished.

"You ran to the man on the ground? Rendered first aid to him?" Crown prosecutor Natalie Adams asked the witness.

Witness: "Yes."

"And you've said that he was already lying in the recovery position and you described him as 'tiny'?"

Witness: "Yes... he was tiny."

The witness told the court Mr Zervas had blood coming from his nose and mouth but that it "wasn't normal blood".

"I had a doctor come over first and then a triage sister and then another nurse and then another Qantas person," said the witness.

In a statement to police, the witness said a man was speaking to the man on the ground saying: "I'm here Tony, I'm here mate, hang in there."

The witness tried to move people back from the scene before going outside to flag down the ambulance.

She earlier described to the court seeing the man on the ground being kicked in the back by two men while a third man kicked him in the stomach.

Earlier, another witness told the hearing the brawl she saw at the airport that day was like "wild dogs" fighting, which left her and the people she was with too shaken to speak at the time to police, who were asking for witnesses to come forward.

"It was as if they were wild dogs fighting," the woman said.

She described "punching and screaming and yelling" and "fisty fights".

"I just got very shaken because I've never witnessed any eye-to-eye fighting like this," she said.

Ten Comanchero bikies are charged with murdering Mr Zervas.

They are: national president Mahmoud "Mick" Hawi, Sydney "road captain" Farres Abounader, Maher Aouli, Sydney secretary Tiago Costa, Ismail Eken, Zoran Kiscanin, Sydney treasurer Frank Larosa, Christian Menzies, Pomare Pirini and Usama Potrus.

Three men linked to the Hells Angels - Peter Zervas, David Padovan and Musa Ovalle - have been charged with affray and riot over the events.

The hearing before magistrate John Favretto, which has now entered its third week, is continuing.

Bikie 'wielded bollard like axe'

WITH a mob of brawling bikies rolled towards her, one airline passenger's fear turned to horror as she watched a man use a metal bollard as if he was chopping wood with an axe, a court has been told.

The woman had not long arrived at Sydney Airport and was checking in for a flight to Melbourne when she witnessed a fatal fight between members of the Hells Angels and Comanchero on March 22 last year.

A committal hearing for 13 bikies was told the woman heard angry shouting and looked up as the brawl spilled out from behind the check-in counters, with men "rolling around, punching and kicking each other".

 

"I just knew that if I stayed where I was they would have … run straight over the top of me," the woman told the Sydney West Trial Court at Parramatta.

As the fight progressed she saw a man pick up a metal bollard. "He stepped to his left, picked it up from the ground and raised it above his head as you would an axe to chop wood … crashed it down to the ground from above his head," she said.

She said the man made the same action two more times before she could look no longer.

"I turned my head away because I realised that if there was a human being lying under that they were very badly injured," she told the court.

"I was absolutely horrified and my knees turned to jelly and my heart was pounding. I couldn't look - I was too frightened."

The men had been only two metres away when she realised she was in danger. "I suppose it's self protection that suddenly kicks in and I was trying to find something to hide behind."

The woman felt compelled to give a police statement as she was "so angry about the lack of security" and had seen only one federal police officer, who arrived at the scene after the men had fled.

Another witness told the court she saw two people she believed to be security guards who "stepped back and basically just watched" as the fight continued.

She saw a man with a bollard in his hands "driving it down and you could just hear the crunching", she told the court.

Neither witness knew until later that night that a Hells Angels associate, Anthony Zervas, 29, had died during the brawl.

Ten Comanchero members - the national president, Mahmoud ''Mick'' Hawi; the ''road captain'', Faress Abounader; the secretary, Tiago Costa; Maher Aouli; Ismail Eken; Zoran Kisacanin; Frank La Rosa; Christian Menzies; Pomare Pirini and Usama Potrus - have been charged with murder in relation to the brawl.

Eight of the 10 have been charged with riot. Hells Angels Musa Ovalle, David Padovan and Anthony Zervas's brother Peter have been charged with riot or affray. The hearing continues.

 

Airport security guards just watched fatal brawl: witness tells court

Security guards working at Sydney Airport during a deadly brawl between rival bikie gangs stood back and watched, a court has heard.

Anthony Zervas, 29, was killed after being stabbed with scissors and a knife and hit with a metal bollard during an "all-in" brawl on March 22 last year near the check-in counters of Qantas Terminal 3.

A frequent flyer who had returned to Sydney with her son on a flight from Melbourne that afternoon told a committal hearing at Sydney West Trial Court in Parramatta today that she saw a group of men lined up behind the check-in counters and heard someone say: "There they are."

 

Another smaller group of men stood about 30 metres away, she said.

The woman rummaged for change in her bag and when she looked up again the two groups were "sparring" with each other.

"Men putting their hands up ready to fight ... It was just like an all-in brawl, just everyone was fighting everyone," the woman told the court.

"At that point I started looking around to see where on earth were the security," she said.

Soon after, she saw what appeared to be two security guards running towards the fight area before she noticed: "They had stepped back and basically just watched."

At one point the woman saw a man's arms raise a steel pole before driving it downwards.

"He was driving it down and you could just hear it crunching," she told the court.

The woman said she did not learn until later that night that someone had died during the brawl.

Under cross-examination, the woman agreed that the security guards might have been uniformed Qantas staff.

Ten Comanchero gang members have been charged with murder in relation to the brawl. Eight of them have been charged with riot.

Three Hells Angels gang members have been charged with riot or affray.

'Did you think you would get away?' Qantas worker tells of deadly airport brawl

"Did you think you would get away?"

Those chilling words were heard shortly before a man was killed during a brawl at Sydney Airport, a court has heard.

Ten members of the Comanchero bikie gang have been charged with murder and three Hells Angels have been charged with riot of affray following fights outside Gate 5 and the check-in counters of Qantas Terminal 3 on March 22 last year.

 

A Qantas customer service officer today told a committal hearing at Sydney West Trial Court in Parramatta that he heard shouting coming from behind his work station and saw what appeared to be a larger group of men following a smaller group.

He told police he heard someone shout the words: "Did you think you would get away?" before two men began to run.

A large group of men ran between the check-in counters and began fighting in front of him.

"I saw someone picking up the steel bollard and at that time I feared for my safety and the other people I was working with so I retreated back from where I was working," he said.

He saw one man pick up the bollard from its shaft, raising it over his left shoulder. But he turned away, telling the court: "I didn't want to see any more."

When the fighting subsided he saw a man lying on the ground, along with a silver knife with an eight-centimetre blade, a pair of brass knuckle dusters and blood spattered on the ground, the court heard.

Photographers spark concern at bikie hearing

A man and woman posing as members of the media were photographing people entering a hearing in which 10 bikies have been charged with murder, a court has heard.

John Korn, a legal representative of one of the men, made the allegations after members of the media told him the photographers were not accredited media.

"I went up to them and asked them politely who they were and what they were doing and they were very reluctant to tell me who they were," Mr Korn told the Sydney West Trial Courts at Parramatta.

 

Shane Flexman, the Chief Inspector of the Parramatta Sheriff's office, said it had no jurisdiction over incidents outside the court and it was "a matter for the police to take further", the court heard.

During a break in proceedings, women in the public gallery were heard accusing another woman of taking photographs of them with her camera phone. The woman denied this.

Ten Comanchero and three Hells Angels members are facing a committal hearing for charges relating to a fatal brawl at Sydney Airport on March 22 last year.

Anthony Zervas, 29, was killed during the clash between members of the Comanchero and Hells Angels motorcycle gangs.

One witness told the court how he shielded his son during the first of two clashes which erupted as passengers were disembarking from a Melbourne flight.

"Someone punched [a man] in the head violently - that was the noise [of] someone contacting with another human," he said.

"I focused on getting my son out of there at that stage. I was also trying to stop other passengers from walking out into the melee."

Another witness told the court of a second fight that broke out minutes later, and her fear when men came "crashing through" the check-in counters. She said she saw three men wielding metal bollards.

Another witness said he heard swearing in English and in Arabic.

He said the men had been "scattered all over the place … throwing punches at each other left right and centre" but "not all of them [were] necessarily landing where they were intended to".

Passengers tells court of fear amid airport brawl

A man revealed "the pink of his eye" to another passenger aboard a flight carrying members of the Hells Angels and Comanchero bikie gangs, ahead of a fatal brawl at Sydney Airport, a court has heard.

The clash in Domestic Terminal three at the airport on March 22, last year led to the death of Anthony Zervas, 29.

A witness, whose identity has been suppressed, gave evidence at the West Trial Court at Parramatta today, during the committal hearing of 10 men charged with murder over Mr Zervas's death and three others charged with riot and affray.

The witness said one man made a gesture to another man on board the flight from Melbourne to Sydney, by pulling down his cheek to reveal the pink of his eye.

"He called out a word I didn't understand ... to a gentleman ... then put his hand to his face and with his finger pulled down his cheek with his hand to reveal the pink of his eye," she said.

Another witness, who also cannot be named, said he saw a "chaotic" fight break out between two groups of men once passengers had disembarked.

"It was chaotic so I really couldn't pinpoint anything in particular as to who was doing what," the witness said.

He gave a detailed description of about five men who were on the flight and who he believed were also involved in the fight.

During the brawl he said he heard "stuff like": "You're dead, you're a f---ing dickhead", as well as the words in Arabic: "Your mum's a slut."

Asked who played what role in the fight, the witness said he could not be sure.

"People were kicking and punching all over the place, not all of them necessarily landing where they were intended to," he said.

Mr Zervas died from stab wounds and head injuries after being repeatedly stabbed with a knife and scissors and hit by a metal bollard.

He was aligned with the Hells Angels and was one of seven of the gang called to the airport as back-up in the anticipation of violence, Crown prosecutor Natalie Adams has told the hearing, which opened yesterday.

Ten members of the Comanchero gang are charged with murder.

They are: national president Mahmoud "Mick" Hawi, Sydney "road captain" Farres Abounader, Maher Aouli, Sydney secretary Tiago Costa, Ismail Eken, Zoran Kiscanin, Sydney treasurer Frank Larosa, Christian Menzies, Pomare Pirini, and Usama Potrus.

Earlier today, an airline passenger told a court today of her fear as a group of large men came "crashing through" the check-in counter and began throwing bollards at each other during a brawl at Sydney Airport.

The woman, who cannot be named, had just received her boarding pass when she heard yelling and the sound of loud footsteps coming closer before three men fell together in a heap in front of her.

"They were just running and it seems like two of them may have tackled one, it's hard to say," the woman told Parramatta Local Court.

The passenger told the committal hearing she saw three men swinging bollards and at least one flew through the air.

"They just kept picking them up and throwing them and hitting with them," she said.

Later, she saw a smaller man fall to the ground.

"I thought I saw him sort of sitting in a sitting position and then stand up and fall and I was waiting for him to stand up again but he didn't," she said.

The woman thought the fight might have lasted between five and 10 minutes.

"We were so afraid, I couldn't even tell you how long it took," she told the court.

More than 60 witnesses are expected to give evidence in coming weeks at the hearing, which continues before magistrate John Favretto.

Zervas died after brawl, court hears

Anthony Zervas died during a "ferocious and vicious" bikie brawl at Sydney Airport after he attacked his alleged killer with a pair of scissors, a court has been told.

Mr Zervas, 29, was stabbed with scissors and a knife, beaten with steel bollards and his head was stomped on in front of scores of witnesses on March 22, 2009.

He was the younger brother of Hells Angel Peter Zervas and was one of seven of the club's associates called to the airport as "reinforcements" on the day.

 

The violence was sparked after a chance meeting between the Hells Angels Sydney president Derek Wainohu and five Comanchero on Qantas flight 430 from Melbourne to Sydney.

"That sighting of Derek Wainohu sparked the chain of events that led to the death of Anthony Zervas at Sydney Airport later that day," Crown prosecutor Natalie Adams told a committal hearing today.

Both sides then launched a flurry of mobile phone calls and text messages calling for members to meet at Sydney Airport.

Ms Adams said the calls showed an intention or expectation of violence.

"There had been conflict between the Comanchero and Hells Angels for a period of about 18 months to two years," Ms Adams said.

"That conflict had already led to some violence including the fire bombing of a shop in Hells Angels territory and the bombing of the Hells Angels clubhouse."

When the five Comanchero members disembarked in Sydney, national president Mahmoud "Mick" Hawi approached and punched Mr Wainohu, before making verbal threats, the Crown alleges.

Ms Adams said those threats included: "You're dead, do you hear me? You're f---ing dead."

Members of both groups finally met near the domestic check-in counter of terminal three.

"Eyewitnesses observed a number of persons pick up [steel] bollards and use them as weapons," Ms Adams said.

Those men are believed to have been both Comanchero and Hells Angels.

"Anthony Zervas was punched and fell to the ground and while he was on the ground he was punched, struck violently to the head with bollards ... and was stabbed with both a knife and a pair of scissors, a broken part of which was found later in his clothing," Ms Adams said.

He died from serious head trauma including multiple fractures to the base of the skull and three stab wounds to the chest and abdomen which punctured his right lung, liver and stomach.

Witnesses have told police that Mr Hawi was one of the the people seen beating Mr Zervas with a bollard.

Ms Adams said that the deceased had tried to attack Mr Hawi earlier with a pair of scissors.

"The deceased ran towards Mr Hawi ... striking him to the left temple with a pair of scissors but was unsuccessful in this manoeuvre because Mr Hawi blocked it with his hand," Ms Adams said.

Most of the men, some bloodied and with torn clothing, fled the airport in cars and taxis after the "short riot", she said.

Ten Comanchero are charged with murder over Mr Zervas's death.

They are: Mr Hawi, the national president, Sydney "road captain" Farres Abounader, Maher Aouli, Sydney secretary Tiago Costa, Ismail Eken, Zoran Kiscanin, Sydney treasurer Frank Larosa, Christian Menzies, Pomare Pirini, and Usama Potrus.

All appeared at Sydney's West Trial Court at Parramatta on Monday, where some watched CCTV footage from the airport on the day of Mr Zervas's death.

Three men linked to the Hells Angels - Peter Zervas, David Padovan and Musa Ovalle - have been charged with affray and riot over the events of March 22 but are excused from attending court.

The hearing, before magistrate John Favretto, is expected to hear from 61 witnesses and last for up to 12 weeks.

 

 

Chance encounter led to fatal airport bikie brawl: court

A chance encounter between members of rival bikie clubs on a flight to Sydney led to the violent death of a Hells Angels associate, a court heard today.

Anthony Zervas, 29, was killed in a brawl at Sydney Airport on March 22 last year between members of the Hells Angels motorcycle club and their rivals, the Comanchero.

On the first day of a committal hearing for 10 Comanchero and three Hells Angels members, Crown prosecutor Natalie Adams said the incident occurred after Derek Wainohu, then president of the Hells Angels Sydney chapter and the president of the Comanchero Sydney chapter, Mahmoud "Mick" Hawi, and other Comanchero boarded the same flight from Melbourne to Sydney.

 

"On the prosecution case it was this chance sighting of Mr Wainohu by the Comanchero on that flight before it departed that sparked the chain of events that would lead to the death of Anthony Zervas at Sydney Airport later that day," she said.

Ms Adams said both sides arranged to be met by bikie members at Sydney Airport.

Seven Comanchero arrived at the airport to meet their counterparts on the flight.

"This number who arrived was consistent with knowledge of their part that what was anticipated was an incident serious enough to require 12 participants," Ms Adams told Parramatta Court.

When the men departed from the flight, witnesses saw a man fitting Mr Hawi's description push or punch Mr Wainohu, Ms Adams said.

Mr Wainohu did not respond with physical violence but another Hells Angels member, David Padovan, became involved in an affray with a group of Comanchero, Ms Adams said.

She said witnesses heard Mr Hawi threaten the Hells Angels, shouting "Next time we see you, you're going to have bullets through you. You're a dead man walking."

A second altercation occurred during which Anthony Zervas was killed.

The court was shown footage of both groups moving throughout the airport but there was no footage of the fatal brawl.

Ten Comanchero - Mr Hawi, Farres Abounader, Maher Aouli, Tiago Costa, Ismail Eken, Zoran Kisacanin, Frank La Rosa, Christian Menzies, Pomare Pirini and Usama Potrus - are charged with murder. Eight are also facing charges of riot and affray.

Anthony Zervas's brother Peter and fellow Hells Angels members, Musa Ovalle and Mr Padovan, have been charged with riot and affray.

The accused Hells Angels were excused from appearing in court.

The committal hearing is expected to run for two months and hear from 61 witnesses who were at Sydney Airport on the day in question, including those now living interstate and overseas.
